Do I Need a Defensible Space Inspection to Sell My Home in Nevada County?
If your home is in a high or very high Fire Hazard Severity Zone, California law (Civil Code 1102.19, from AB 38) requires you to give the buyer defensible space documentation when a local ordinance or inspection program provides it. If you don’t have it, you and the buyer sign an agreement for the buyer to get it, generally within one year after closing. In western Nevada County, CAL FIRE real estate inspections can be requested.
Which homes the rule covers
The requirement applies to residential sales covered by California’s transfer disclosure rules when the home is in a high or very high Fire Hazard Severity Zone. That includes zones in State Responsibility Areas and in local (city or county) areas. It has applied to sales since July 1, 2021. Much of unincorporated western Nevada County is in a State Responsibility Area, so many foothill homes are covered. Check your address on CAL FIRE’s map.
What the seller provides
- Where a local ordinance requires compliance documentation: the seller gives the buyer a copy of that documentation and names the agency that can provide a copy.
- Where there’s no ordinance but an agency offers inspections: the seller provides documentation from an inspection within the prior six months.
- If the seller doesn’t have it: buyer and seller sign a written agreement that the buyer will obtain documentation, within one year after close of escrow where no ordinance applies.
An agreement between buyer and seller doesn’t stop fire agencies from enforcing defensible space law on the property.

What defensible space means
State law requires 100 feet of defensible space around structures, or to the property line if that’s closer. Nevada County also enforces its own hazardous vegetation ordinance. In August 2026, the State Board of Forestry approved regulations for the 0 to 5 foot “ember-resistant zone” closest to homes, with phased timelines for existing homes. Check the Board’s page for the effective date and current requirements.

Request the inspection before you list. Clearing brush and fixing items early improves photos, reassures buyers and insurers, and keeps the disclosure simple.
